What is a risk analysis?

Why is such a document essential for any litigator or negotiator? Yet why are such documents so uncommon? This paper will address these questions and provide illustrations from litigation and mediation practice. Some precedent forms will also be included to assist in preparing risk analyses.

John Wade is a professor of law and director of the Dispute Resolution Centre at Bond University in Queensland, Australia. John is a practising lawyer and mediator on leave in Vancouver during 2010. He has published over 100 books and articles; conducted over 6000 hours of mediation; taught at Osgood, Manitoba, Calgary, Vermont, Pepperdine, SMU and Lyon law schools; and received multiple teaching awards including best law teacher in Australia. John's interests include his family, historical biographies and tennis.
